Terms of Service

1. Service Description

TariffCenter.AI (“the Service”) is an AI-powered informational platform that provides tariff data lookups, HS code research, landed cost estimates, and trade policy analysis. The Service is operated by TariffCenter.AI (“we,” “us,” “our”).

The Service is an informational research tool, not a customs brokerage. We are not a licensed customs broker under 19 U.S.C. § 1641 or 19 CFR Part 111. We do not prepare customs entry documents, make binding classification determinations, or transact customs business on behalf of any user.

2. AI-Generated Content & Third-Party AI Services

Responses provided by the Service are generated by artificial intelligence and may contain errors. AI-generated content does not constitute professional customs, legal, tax, or trade compliance advice. You should independently verify all information before making business decisions.

The Service uses the following AI providers to process your queries:

  • Anthropic (Claude API) — generates tariff analysis responses. When you submit a query, your input text and relevant context are sent to Anthropic for processing. See Anthropic’s Privacy Policy.
  • Voyage AI — generates semantic search embeddings to find relevant policy documents. Your query text is sent to Voyage AI and converted to numerical vectors. See Voyage AI’s Privacy Policy.

These providers process your data under their own privacy policies and terms. By using the Service, you acknowledge that your query data will be transmitted to these providers and processed according to their respective policies. If you do not agree with their terms, you should not use the Service.

3. Account Registration

To access certain features, you must create an account with accurate, current information. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to notify us immediately of any unauthorized use.

4. Subscription and Billing

Paid subscriptions are billed monthly through Stripe. You authorize recurring charges to your payment method. You may cancel at any time; cancellation takes effect at the end of your current billing cycle. Refunds are handled according to Stripe’s policies. We reserve the right to change pricing with 30 days’ notice.

Query credits reset monthly. Unused credits do not roll over. We do not charge overage fees; once credits are exhausted, you must upgrade or wait for the monthly reset.

5. Acceptable Use

You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to circumvent rate limits, credit systems, or security measures; (c) scrape, crawl, or bulk-download data from the Service; (d) resell or redistribute data obtained from the Service without our written consent; (e) submit false or misleading product descriptions with intent to obtain fraudulent classifications.

6. Intellectual Property

Tariff data sourced from USITC, Federal Register, CBP, and USTR is in the public domain. Our proprietary elements — including the AI analysis layer, user interface, API, and branding — are protected by applicable intellectual property laws. You retain ownership of data you submit (product descriptions, query text).

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ACCURATE, COMPLETE, UNINTERRUPTED, OR ERROR-FREE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, COSTS OF CUSTOMS PENALTIES OR DUTIES, BUSINESS INTERRUPTION, OR SHIPMENT DELAYS. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING YOUR CLAIM.

These limitations do not apply to liability arising from our gross negligence, willful misconduct, or breach of applicable data protection laws.

9. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from: (a) your use of the Service; (b) your reliance on AI-generated classifications or calculations for customs declarations; (c) your violation of these Terms.

10. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to our data practices as described in the Privacy Policy.

11. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time through your account settings. Upon termination, we will delete your data in accordance with our data retention policy, except where retention is required by law (e.g., payment records for tax compliance).

12. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via email or a notice on the Service. Continued use after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.
